Nick acts for insolvency practitioners, banks and other lenders, and companies in all aspects of corporate and personal insolvency, and in commercial litigation. He has been a specialist in insolvency and restructuring since 2010.

Biography

Nick acts for insolvency practitioners, major Australian and international banks, non-bank lenders, publicly listed companies and financial services providers. He is appointed by the Victorian Legal Services Board to manage legal practices in financial or operational difficulty. He is based in Melbourne.

Nick advises across all aspects of corporate insolvency including receivership, voluntary administration and liquidation, and personal insolvency. He also acts for a range of parties involved in commercial litigation. His experience includes first-hand in-house banking experience gained as Legal Counsel at Fortis Bank in Dublin (now Credit Suisse), which specialised in the provision of banking services to investment funds.

Nick has more than 16 years of specialist experience in insolvency and commercial litigation. He led the successful defence of Western United Football Club in Federal Court winding-up proceedings brought by the ATO in respect of A$18 million in outstanding tax debts, obtaining orders on appeal setting aside the winding-up decision and allowing the club to continue operations. He acts for Australia’s largest insolvency and restructuring firms, which has included Teneo, Deloitte, McGrathNicol, Ernst & Young, Grant Thornton and FTI Consulting.

Nick combines insolvency depth with in-house banking experience and cross-border perspective gained from his time in Ireland. His accounting qualifications inform his commercial approach to credit-related disputes and insolvency engagements.

Led the successful defence of A-League club Western United in Federal Court winding-up proceedings initiated by the ATO regarding A$18 million in outstanding tax debts.

Acted for the Liquidators of the international franchised early childhood development services provider, and facilitated a successful sale to allow the business to continue.

Recovery litigation — Major banks and lenders

Conducts recovery litigation on behalf of financiers including major Australian banks and lenders, including obtaining urgent injunctions to freeze funds and enforcing security across property and other asset classes.

Victorian Legal Services Board

Appointed by the Victorian Legal Services Board to manage various legal practices that have encountered financial and operational difficulties.

Environmental litigation

Successfully obtained orders against a multinational polluter in Victoria's first significant case relating to third-party enforcement rights under the Environment Protection Act.
