Biography
Madeleine acts for a broad range of clients across fashion, health and wellness, consumer goods, medical technology, automotive and retail sectors. Her clients include household-name Australian and global brands, in addition to growing Australian businesses and start-ups requiring both transactional and contentious IP advice.
Madeleine advises on trade mark clearance, filing, prosecution, oppositions and enforcement, including acting in opposition and removal proceedings before IP Australia and the Federal Court of Australia. Her practice covers IP licensing, commercialisation arrangements, brand protection strategy and IP aspects of commercial transactions. In addition, she advises on the protection of confidential information and trade secrets, and acts in enforcement matters concerning all intellectual property rights.
She also regularly advises on consumer law matters, online marketplace enforcement and border protection programs.
Madeleine manages domestic and international trade mark and design portfolios and advises on multi-jurisdictional IP matters and disputes. She also acts in Federal Court of Australia proceedings for major Australian retailers, automotive aftermarket companies and global brands on trade mark, copyright, design and confidential information disputes. She supports the broader IP practice on complex matters spanning litigation, commercialisation and portfolio strategy.
Madeleine brings experience across all aspects of intellectual property law, from both front-end IP prosecution and transactional work, enabling integrated advice on protection strategy and enforcement. Her practice sits within one of Australia’s largest IP teams, giving her access to deep specialist capability across trade marks, patents, copyright and technology law.

Represents one of Australia’s largest retailers of fashion, accessories, footwear, stationery and gifts in all copyright and trade mark infringement disputes over the past eight years, including proceedings in the Federal Court of Australia.
Federal Court — Reputational rights and automotive aftermarket
Acts in design infringement, trade mark infringement, passing off and misleading or deceptive conduct proceedings for one of Australia’s largest retailers and distributors of automotive aftermarket parts and accessories.
Federal Court — Breach of confidence and copyright
Acts in breach of confidence and copyright infringement proceedings in the Federal Court, including urgent interlocutory relief applications, for a designer and manufacturer of luxury offroad caravans.
Federal Court — Copyright and design overlap
Successfully defended copyright infringement claims concerning works of artistic craftsmanship in the Federal Court and Full Federal Court, at first instance and on appeal.

Acts in domain name dispute proceedings under WIPO’s Uniform Domain Name Dispute Resolution Policy and auDA’s .au Dispute Resolution Policy to transfer domain names held by cyber squatters or third parties acting in bad faith.
