Biography

Josh acts for major infrastructure developers, energy companies, EPC contractors, BOP contractors and government-facing entities. His clients include global technology and energy companies, pipeline operators, project developers and state-initiated project finance vehicles. He is based in Melbourne and advises on projects across Victoria and nationally.

Josh advises on risk mitigation for project delivery, front-end drafting and negotiation of construction and infrastructure contracts, and energy agreements relating to gas and electricity, including sale, purchase, transmission, and operations and maintenance. He acts for parties in construction and infrastructure disputes and advises on state-initiated project finance structures. His energy practice includes NEM participation agreements, utility-scale battery storage, virtual power plants and automated bidding systems.

Josh’s project experience spans some of Australia’s most significant energy infrastructure transactions, including the world’s largest utility-scale battery project at Jamestown, South Australia, and the South Australian Virtual Power Plant involving up to 250 MW of distributed capacity. He has acted on 600 km gas pipeline EPC contracts, major wind farm reconstructions arising from contractor insolvency, and complex O&M arrangements across the NEM. His infrastructure work also spans hospitals, schools, major sporting facilities, residential and government projects.

Josh brings rare combined depth across construction contracting and energy law, enabling him to advise on the full delivery and commercial framework for major energy infrastructure projects. He is a regular contributor to industry education through guest lecturing at the University of Melbourne and Monash University.

Tesla South Australian virtual power plant

Acted for Tesla on the SA Virtual Power Plant Project, involving the construction and operation of up to 250 MW of distributed solar PV and battery storage across SA Housing properties statewide, including drafting and negotiating the Project Agreement with the State, Supply and Install and O&M Agreements, and advising on retail services, regulatory matters and project financing.

Tesla Hornsdale power reserve

Acted for Tesla on the world’s largest utility-scale battery project at Jamestown, South Australia, across all aspects of the transaction including the Project Agreement with the State, EPC and O&M Contracts, downstream procurement and supply contracts, and the Market Participation Agreement for commercial operation.

Northern Goldfields Interconnect

Acted for the EPC Contractor on the EPC Contract for the delivery of the Northern Goldfields Interconnect, a 600 kilometre gas pipeline from the Goldfields gas basin to Geraldton in Western Australia.

Lincoln Gap wind farm

Acted for a BOP contractor in the reconstruction and completion of Stage 1 of the Lincoln Gap Wind Farm Project following the insolvency of the EPC Contractor and turbine supplier Senvion GmbH, involving court proceedings and restructuring of project documents with the developer and financiers.
